The System of the Foreigner’s Work Permit in China is a system by which the Chinese government implements uniform access standards, approval and supervision for foreigners applying to work in China. Under the system, the original foreign experts’ work permit and foreigners’ work permit instruments have been replaced by a Notification Letter of Foreigners Work Permit, which is available online for employers and applicants to download and print out. The original Foreign Expert Certificate and Alien Employment Permit have been replaced by a Foreigner’s Work Permit, which is a legal certificate for foreigners working in China. Every foreigner is assigned one number for life.

外國人來華工作許可制度是中國政府對外國人申請到中國工作實行統(tǒng)一準(zhǔn)入標(biāo)準(zhǔn)和審批監(jiān)管的制度。外國人來華工作許可將原《外國專家來華工作許可證》《外國人就業(yè)許可證》統(tǒng)一為《外國人工作許可通知》，采用電子化形式，用人單位和外國申請人可直接在線打印；原《外國專家證》和《外國人就業(yè)證》統(tǒng)一為《外國人工作許可證》。《外國人工作許可證》是外國人在中國工作的合法證件，“一人一號”、終生不變。

Article 41 under Exit and Entry Administration Law of the People’s Republic of China: Foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations. No entities or individuals shall employ foreigners who have no work permits or work-type residence permits.

根據(jù)《中華人民共和國出境入境管理法》第四十一條規(guī)定：外國人在中國境內(nèi)工作，應(yīng)當(dāng)按照規(guī)定取得工作證和工作類居留證件。任何單位和個人不得聘用未取得工作許可和工作類居留證件的外國人。

4.Who will be reviewed and what are the criteria in the application for foreigner’s work permit in China?

The legal employers in China and their foreign employees will be reviewed on the application for foreigners’ work permit in China.

審批對象：中華人民共和國境內(nèi)依法設(shè)立的用人單位聘用外國人來華工作許可的申請和辦理，審批對象為聘用外國人的用人單位和外國人。

(1) Basic Requirements for Employers (a) Employers shall be established by law, without serious illegal and dishonest acts; the employment of foreigners shall be for special needs and the appropriate candidates are in short supply in China, while the post doesn’t violate any government regulations; the salary or remuneration for those foreigners shall not be lower than the local minimum wage. (b) For pre-approval by the industry competent authority by law, it shall be approved.

用人單位基本條件：(1)依法設(shè)立，無嚴(yán)重違法失信記錄；聘用外國人從事的崗位應(yīng)是有特殊需要，國內(nèi)暫缺適當(dāng)人選，且不違反國家有關(guān)規(guī)定的崗位；支付所聘用外國人的工資、薪金不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。(2)法律法規(guī)規(guī)定應(yīng)由行業(yè)主管部門前置審批的，需經(jīng)過批準(zhǔn)。

(2) Basic Requirements for Applicants?

(a) Capable applicants with qualified professional skills or knowledge shall have a clearly-defined employer in China and shall be at least 18 years old in good health and without criminal record.?(b) Those applicants shall engage in urgently needed jobs in China and can make contributions to China’s economic and social development.?(c) The laws and regulations which have special provisions, if any, for the employment of foreigners in China shall prevail.

（二）申請人基本條件：（1）應(yīng)年滿18周歲，身體健康，無犯罪記錄，境內(nèi)有確定的用人單位，具有從事其工作所必需的專業(yè)技能或相適應(yīng)的知識水平。（2）所從事的工作符合我國經(jīng)濟(jì)社會發(fā)展需要，為國內(nèi)急需緊缺的專業(yè)人員。（3）法律法規(guī)對外國人來華工作另有規(guī)定的，從其規(guī)定。

According to the?Notice on Comprehensively Implementing the System of the Foreigner’s Work Permit in China?(No. 40 [2017] SAFEA), foreigners working in China are divided into Foreign High-end Talents (Category A), Foreign Professionals (Category B), Other Foreigners (Category C).

根據(jù)《關(guān)于全面實施外國人來華工作許可制度的通知》（外專發(fā)[2017]40號），來華工作外國人分為外國高端人才（A類）、外國專業(yè)人才（B類）、其他外國人員（C類）

6.What is the basic procedure for applying for a Foreigner’s Work Permit?

(1) Foreigners outside China

外國人在境外：

Application for Notification Letter of Foreigner’s Work Permit —Work Visa (Chinese Embassy and Consulate Abroad)—Entry with a Z Visa—Application for Foreigner’s Work Permit—Work Residence Permit (Entry and Exit)

申請許可通知—工作簽證（中國駐外使領(lǐng)館）—持Z字簽證入境—申請許可證—工作類居留許可（出入境）

(2) Foreigners in China

外國人已入境：

Foreigners who have entered China and?on certain conditions may apply directly for the?Foreigner’s?Work Permit.

符合一定條件的已入境申請者可以申請境內(nèi)直接辦理許可證：

Application for Foreigner’s Work Permit — Work-type Residence Permit (Entry and Exit)??or

Application for Notification Letter of Foreigner’s Work Permit — Work-type Residence Permit (Entry and Exit) — Application for Foreigner’s Work Permit

申請許可證—工作類居留許可（出入境）

或者：申請許可通知—工作類居留許可（出入境）—申請許可證

Note: Those who do not meet the conditions mentioned above and have already entered China shall follow the procedure on the newly issued?Notification Letter of Foreigner’s Work Permit.

注：不符合直接辦理《外國人工作許可證》情形的，但已入境的申請人，仍須按新辦《外國人工作許可通知》程序辦理。

7.What are the convenience measures for Foreign High-end Talents (Category A) applying for a Foreigner’s Work Permit?

(1) No limits of age, academic qualification or work experience

（一）無年齡、學(xué)歷、工作經(jīng)歷限制。

(2) Pledge system for certificate of no criminal record

（二）無犯罪記錄證明采用承諾制。

(3) Those who have entered China with a visa or a valid residence-type permit may directly apply for?the?Foreigner’s?Work Permit.

（三）持其他簽證或有效居留證件已入境的，可境內(nèi)申請外國人來華工作許可。

(4) A Foreigner’s?Work Permit?with a validity period of up to 5 years

（四）給予最長期限達(dá)5年的《外國人工作許可證》。
